Holding
The court held that the applicant is not entitled to temporary bail as the seriousness of the offence and unsatisfactory jail conduct do not justify its grant.
Summary
The applicant, Rupeshkumar @ Raju Rameshbhai Nat (Marwadi), filed a temporary bail application through jail. The jail records indicated that he had been released in July 2025, is implicated in a serious offence, and his conduct while in custody was unsatisfactory. The court examined whether these circumstances warranted the grant of temporary bail. Finding that the seriousness of the alleged crime and the poor jail conduct provided no sufficient ground for bail, the court rejected the application. The order was directed to be communicated to the jail authority.
Issues considered
- Whether the applicant is entitled to temporary bail despite the seriousness of the offence and unsatisfactory jail conduct?
