High Court of Gujarat

DHARMESH SHAILESHBHAI FATEKAR THROUGH KAILASHBEN DHARMESHBHAI FATEKARversusSTATE OF GUJARAT

Disposal
53-ALLOWED / GRANTED @ ADM.STAGE

Holding

The court set aside the order of the Additional Sessions Judge and granted bail on condition of a personal bond, allowing the applicant to file a criminal appeal with condonation of delay upon deposit of the required amount.

Summary

The applicant, Dharmesh Shaileshbhai Fatekar, had a non‑bailable warrant converted to a bailable warrant on the condition of paying 20% of a cheque amount, which he could not arrange due to financial constraints. The 4th Additional Sessions Judge refused to condone a 403‑day delay in filing the appeal and ordered continued detention. The applicant subsequently deposited a demand draft of Rs 5,00,000 with the Nazir of the District Court, Ahmedabad, satisfying the financial condition. The High Court set aside the Additional Sessions Judge’s order, permitted the applicant to file a criminal appeal with a fresh delay‑condonation application, and released him on bail upon execution of a personal bond of Rs 10,000 with a surety, subject to conditions. The application for revision was allowed, and the order was communicated to the concerned court.

Issues considered

  • Whether the 403‑day delay in filing the criminal appeal can be condoned.
  • Whether the deposit of Rs 5,00,000 satisfies the condition for converting the warrant to bailable and warrants bail.
  • Whether the order of the 4th Additional Sessions Judge should be set aside.
