The revision application was dismissed as infructuous because the parties settled the matter in the National Lok Adalat.
Summary
The petitioner, Sumitraben Sundarsingh @ Ashaben, filed a criminal revision application challenging an order of the I/C 4th Additional Sessions Judge, Surat, dated 13-12-2025 in Criminal Appeal No. 582 of 2024. While the revision was pending, the parties reached a settlement through the National Lok Adalat. The High Court observed that the settlement rendered the revision application infructuous. Consequently, the Court disposed of the application without further hearing. The notice issued in the revision was discharged and any interim relief that had been granted was vacated.
Issues considered
- Whether a criminal revision application becomes infructuous and must be dismissed when the parties settle the dispute in a National Lok Adalat.
- Whether any interim relief granted in the revision should continue after the settlement.
