Disposal
DISMISSED AS INFRUCTUOUS

Holding

The revision application is dismissed as withdrawn, with liberty granted to the applicant to approach the PMLA Special Court for restoration of confiscated property.

Summary

The liquidator of M/s Champion Agro Ltd. filed a criminal revision application before the Gujarat High Court challenging an order of a subordinate court in a matter involving the Directorate of Enforcement. The applicant contended that the charges had already been framed, rendering the revision infructuous, and sought liberty to approach the PMLA Special Court for restoration of confiscated property. The Court, after hearing counsel, noted that the matter was indeed infructuous and that the applicant could file a fresh application before the Special Court. Consequently, the High Court disposed of the revision as withdrawn, expressly reserving liberty to the applicant to seek relief in the appropriate forum. The Court clarified that it had not examined the merits of the underlying case and that the trial court would consider any future applications as per law.

Issues considered

  • Whether the criminal revision application is maintainable when charges have already been framed and the matter is infructuous
  • Whether the applicant should be granted liberty to file a fresh application before the PMLA Special Court for restoration of confiscated property
