The petition is dismissed as not pressed, but the petitioners are permitted to file an application under Order VI Rule 16 and Order XIV Rule 2 of the CPC.
Summary
The petitioners filed a Special Civil Application under Article 227 of the Constitution seeking to quash a common order dated 13‑03‑2026 passed by the 2nd Additional Senior Civil Judge, Junagadh, and to stay further proceedings in Special Civil Suit No. 21 of 2017. During the hearing, senior counsel for the petitioners indicated that they would not press the petition. The High Court observed that it had not examined the merits and, since the petition was not pressed, allowed the petitioners to file an application under Order VI Rule 16 and Order XIV Rule 2 of the CPC before the trial court for framing a preliminary issue. The Court granted this permission, vacated any interim relief, and disposed of the petition as not pressed without awarding costs.
