Holding
The Court held that the petitioner may seek condonation of the delay from the jail authority, and the petition is disposed with liberty to move the authority.
Summary
The petitioner, Dilipji Varsangji Thakor, filed a special criminal application seeking regularisation of the period of his late surrender. The application was heard by Justice Sanjeev J. Thaker of the Gujarat High Court. The Court referred to observations made by a Division Bench in Criminal Misc. Application No. 1360 of 2014 in Criminal Appeal No. 2884 of 2008, which dealt with condonation of delay in surrender. Relying on that precedent, the Court disposed of the present petition but granted the petitioner liberty to approach the concerned jail authority for condonation of the delay. The Court directed that any such application be decided by the jail authority in accordance with law.
Issues considered
- Whether the period of late surrender can be regularised and the delay condoned under criminal procedure law.
