Disposal
38-RULE ABSOLUTE/ALLOWED @ FH

Holding

The Court exercised its discretion and granted the petitioner parole for seven days upon a personal bond of Rs.10,000, subject to standard conditions.

Summary

Ganesbhai Balubhai Ghodia Patel filed a special criminal application seeking parole leave on the ground of agricultural purpose. The Additional Public Prosecutor waived service on behalf of the State. After hearing the parties and considering the petitioner's averments and jail remarks, the Court exercised its discretion in favour of the petitioner. The petition was partly allowed, granting parole for seven days upon furnishing a personal bond of Rs.10,000 to the jail authority, subject to usual terms and conditions and reporting to the police station during the leave. The petitioner must surrender to the jail authority at the expiry of the parole period.

Issues considered

  • Whether the petitioner is eligible for parole leave on the ground of agricultural purpose
  • Whether the Court may exercise its discretion to grant parole despite the nature of the offence
