SURAJKUMAR GORELAL CHAUHANversusSTATE OF GUJARAT

Disposal
28-REJECTED @ ADM.STAGE

Holding

The Court declined to exercise its discretion to grant parole, rejecting the petition.

Summary

Surajkumar Gorelal Chauhan filed a Special Criminal Application seeking a 30‑day parole to provide financial assistance to his family. The jail records revealed that during a previous parole, the petitioner absconded for 677 days. The Court examined whether the discretion to grant parole could be exercised in view of the petitioner’s past misconduct. Considering the serious breach of trust, the Court held that it could not exercise its discretion to grant parole. Consequently, the petition for parole was rejected and the order was directed to be communicated to the jail authority.

Issues considered

  • Whether parole should be granted to a prisoner who previously absconded for an extended period despite the applicant's claim of financial need.
