The petition for parole leave was rejected.
Summary
The petitioner, Abhaybhai Pratapbhai Thakor, filed a Special Criminal Application seeking parole leave. The jail records indicated that the petitioner had been absconded for 1,065 days in 2021 and that his conduct in jail was poor. The court examined whether these circumstances satisfied the criteria for granting parole. Considering the prolonged abscondence and unsatisfactory conduct, the court found no sufficient ground to grant parole. Consequently, the petition for parole leave was rejected and the order was directed to be communicated to the jail authority.
Issues considered
- Whether the petitioner is eligible for parole leave despite a prolonged period of abscondence and poor jail conduct
