Summary

The State of Maharashtra filed an application for leave to appeal against the order of the trial court in a criminal matter involving Gunvant Mohan Bhondekar (Respondent No.1) and another respondent. The High Court considered whether leave to appeal should be granted, whether bail could be ordered under Section 431 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and whether a legal services counsel should be appointed for the unrepresented second respondent. The Court found merit in the application, granted leave to appeal and admitted the appeal. It directed the trial court to grant bail to Respondent No.1 in accordance with Section 431 of the 2023 Act. Additionally, the Court ordered the Legal Services Authorities to appoint a suitable counsel from their panel for Respondent No.2, who had not engaged an advocate.
