Bombay High Court

VAIBHAV BALASAHEB SATHEversusTHE STATE OF MAHARASHTRA

Disposal
APPLICATION ALLOWED

Holding

The court granted anticipatory bail, holding that the absence of independent evidence linking the applicant to the offences warranted bail despite the seriousness of the alleged crimes.

Summary

The applicant, Vaibhav Balasaheb Sathe, filed an anticipatory bail application in connection with a crime registered under Sections 3, 4, 5, 7, 8 of the Immoral Traffic Prevention Act and Section 99 of the Bharatiya Nyaya Sanhita. The prosecution’s case relied mainly on statements of a co‑accused and members of the raiding party, with no independent evidence linking the applicant to the offences. The victims did not support the prosecution’s case. The court examined the seriousness of the alleged offences and the lack of substantive evidence. Finding that there was no independent material to establish the applicant’s involvement, the court granted anticipatory bail subject to standard conditions, including furnishing a bond, attending police as required, and not contacting or influencing witnesses.

Issues considered

  • What is the appropriate basis for granting anticipatory bail when the prosecution lacks independent evidence against the applicant?
  • Do statements of co‑accused and raiding party members suffice to justify denial of anticipatory bail?
  • Does the seriousness of the alleged offences under the Immoral Traffic Prevention Act preclude the grant of anticipatory bail?
