The court confirmed the anticipatory bail, directing release on bail upon furnishing a personal bond and surety.

Summary

The High Court of Bombay, Aurangabad bench considered an anticipatory bail application filed by Mehedi Rahim Hannure in connection with criminal case No. 266/2025 alleging assault, robbery and other offences under the Bhartiya Nyaya Sanhita, 2023. The informant alleged that the applicant broke a lock, assaulted him, and stole a gold chain and Rs 35,000. The applicant argued that the court had already granted interim bail on 14 October 2025 and that he had cooperated with the investigation, while the prosecution contended that the stolen items had not been recovered. The court examined the earlier order, noted that the charge‑sheet had been filed and there was no grievance regarding the applicant’s attendance, and held that there was no justification to deny bail. Consequently, the court confirmed the anticipatory bail, directing the applicant to furnish a personal bond of Rs 15,000 with surety and to cooperate with the trial. The order also prohibited tampering with evidence.

Issues considered

  • Whether anticipatory bail should be confirmed after filing of charge sheet despite non‑recovery of the stolen property?

                                     DATE : 18TH AUGUST, 2026.

                 ORDER :

. Applicant seeks pre-arrest bail in correction with Cr. No.
266/2025 registered with Paranda police station for the offences
                 punishable U/Sec. 119(1), 115(2), 352, 351(2), 3(5) of the Bhartiya
                 Nyaya Sanhita, 2023.

                 2. In short it is case of the informant that on 20.09.2025 he
heard noise and hence he came out of the house. He saw that
applicant breaking lock of the shutter. When the informant
questioned him, quarrel took place between them. It is claimed
by informant that applicant assaulted him with fist blows and
snatched gold chain on his person and cash of Rs. 35,000/-.

3. Learned counsel for the applicant submits that this Court
after considering entire facts of the case has protected liberty of
the applicant by order dated 14 th October, 2025. It is his
submission that on conclusion of investigation charge sheet has
been filed and interim relief be confirmed.

4. Learned A. P. P. opposes confirmation of interim relief by
submitting that chain as well as cash is yet to be recovered from
the applicant.

5. Perusal of previous order of this Court reveals that
applicant was directed to attend concern police station and
cooperate in the investigation. There is no grievance made by
the prosecution about attendance of the applicant as directed.
Moreover, since charge sheet has already been filed, there is no
reason/justification not to confirm the interim relief.

6. Hence anticipatory application stands allowed in terms of
interim order dated 14.10.2025. Hence the following order.

                               ORDER
