Anticipatory bail is granted to the applicant, subject to a personal bond of Rs. 25,000, one surety of the same amount, and a condition of cooperation during investigation and trial.

Summary

The applicant, Suresh Menghraj Shroff, sought anticipatory bail after an FIR (No. 678 of 2026) was lodged alleging cheating under Sections 111 and 316(5) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, in connection with a flat purchase dispute. The applicant argued that responsibility for the development project had been transferred to another accused and that the dispute was purely commercial, supported by consent terms filed in a prior execution proceeding. During the bail hearing, the complainant signed a consent document on 8 September 2026 stating he would not pursue the FIR against the applicant, and the second accused raised no objection to confirming the interim protection. The State highlighted the applicant’s criminal antecedents but accepted the settlement. The Court, noting the complainant’s clear withdrawal and the commercial nature of the dispute, confirmed the interim protection and granted anticipatory bail subject to a personal bond of Rs. 25,000 and one surety of equal amount, with a condition of cooperation during investigation and trial.

Issues considered

  • Whether anticipatory bail can be granted when the complainant withdraws his wish to prosecute in a case arising from a commercial dispute.
  • Whether the existence of a settlement and consent terms negates the applicability of Sections 111, 316(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the applicant’s alleged criminal antecedents preclude the grant of anticipatory bail.

offence is registered against two accused persons who are developers and

who have undertaken the work of development of the building.

4. Learned counsel for the applicant submits that the applicant is

arraigned as accused no.1 and that the entire project was handed over to

accused no.2, as reflected in the consent terms dated 09 th May, 2024

submitted before this court in Commercial Execution Application(L) No.

15176 of 2023 (Exhibit- F). She submits that the offence is registered in the

background of commercial disputes in between the complainant and the

developer and that since the entire responsibility for development has been

shouldered upon the accused no.2, the allegations of cheating against this

applicant does not survive. By inviting attention to the consent terms

recorded in Commercial Execution Application (L) No. 15176 of 2023 (at

applicant and in view of this, learned counsel for the respondent no.2,

submits that he has no objection for confirmation of the interim protection

granted in favour of the applicant. A copy of the consent terms is tendered

across the bar. The same is taken on record and marked as document “X” for

identification purposes.
