The court granted anticipatory bail to the applicant with conditions, finding no active role attributable to him.

Summary

The applicant, Savansingh Kalusingh Junni, filed an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with a FIR alleging assault with weapons during a family dispute. The FIR charges him under Sections 25 and 4 of the Arms Act, 1959, Sections 135, 37(1) and 37(3) of the Maharashtra Police Act, 1951, and Sections 352, 118(2), 189(2) and 189(4) of the Bharatiya Nyaya Sanhita, 2023. The prosecution narrative describes a violent altercation in which several relatives of the applicant attacked the complainant’s family, but the applicant’s counsel argued that he had no active role and that other accused have already been arrested and released on regular bail. The court examined the allegations, noted the applicant’s familial relationship with the complainant, and found no direct participation attributable to him. Consequently, the court granted anticipatory bail subject to stringent conditions, including furnishing a bond, regular police reporting, and non‑interference with witnesses. The application was disposed of accordingly.

Issues considered

  • Whether anticipatory bail can be granted to the applicant under Section 482 of the BNSS despite allegations of involvement in assault and weapons offences
  • Whether the applicant’s alleged participation, as merely named in the FIR, warrants denial of bail

3. The prosecution case is set out in paragraph Nos.2A to 2D of

the Anticipatory Bail Application, which reads as under:

“2. That the facts leading to the present
application are capsulized herein for sake of
            brevity and convenience.

            A. The prosecution case is that, on 24.03.2026 at
about 7:30 p.m., the complainant Rohitsingh
Surjitsing Bhond was present at his residence
situated at Rathi Ramnagari, Bibwewadi, Pune
along with his family members. On that day, the
complainant's wife Nehakor Bhond returned to
her matrimonial home along with her mother
Dipmalakor Junni and their minor daughter. A
            dispute allegedly arose between the
complainant's family and the relatives of his wife
regarding a family matter. During the course of
the quarrel, it is alleged that the complainant
slapped his wife, whereupon her mother
informed her relatives about the incident.

            B. It is further alleged that at about 8:30 p.m.,
            accused persons namely Sagarsing Junni,
            Pillusing Junni, Krishnasing Junni, Amolsing

complainant's residence and formed an unlawful

accused persons started quarreling with the
complainant and his family members. During the

said incident, accused Pillusing Junni allegedly
            assaulted the complainant's brother Ronaksing
Bhond with a dagger-like knife and stones,
causing injuries to his head and back. It is further
alleged that thereafter the accused persons
            assaulted the complainant's father Surjitsing
Bhond with a knife-like weapon and stones,
            causing injuries to him

            C. The prosecution further alleges that when the
complainant intervened to rescue his father, he
was also assaulted by the accused persons and
sustained injuries. Thereafter, the injured persons
were shifted to Suraj Hospital and subsequently
to other hospitals for medical treatment.

            D. Thereafter the present Complaint came to be

37(1),37(3) and 135 of Maharashtra Police Act.”

4. Perusal of the prosecution case shows that the Applicant and

the injured are close relatives. The alleged incident has taken place

as the First Informant’s wife was not calling the Complainant’s

father on a video call.

5. Learned Counsel appearing for the Applicant submits that

although there are two other antecedents, the Applicant has been

released on bail in those antecedents and that the Applicant is not

involved in the crime. He submits that the accused Nos.1 and 7 are

involved in the crime and they have been arrested and chargesheet

has been filed against them and they have been released on regular

bail.

6. As the Applicant and the First Informant are relatives and

although the Applicant’s name is mentioned in the FIR, no active

role is attributed to the Applicant, the case is made out for grant of

Anticipatory Bail by imposing stringent conditions.
