Bombay High Court
SUNIL DADA ALIAS MAHADEV NARUTEversusSTATE OF MAHARASHTRA AND ANR.

The Court granted anticipatory bail to the applicant, subject to specified conditions.
Summary
Sunil Dada alias Mahadev Narute applied for anticipatory bail fearing arrest in Crime No. 10 of 2026 registered at Natepute Police Station, Solapur, for offences under Sections 108, 80, 115(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The applicant pleaded innocence, arguing that the FIR lacks any specific overt act linking him to the alleged crimes, while the State contended that the offences are serious and opposed bail. The Court noted that the marriage took place in 2024 and the alleged suicide occurred on 16 January 2026, finding no proximate reason to deny liberty. Accordingly, the Court granted anticipatory bail on a personal bond of Rs 25,000 with one surety, imposing conditions of weekly police attendance, non‑tampering with evidence, and furnishing of residential details. The application was subsequently disposed of as allowed, with the conditions remaining in force.
Issues considered
- Whether anticipatory bail should be granted in a case involving serious offences under the Bhartiya Nyaya Sanhita, 2023.
- Whether the absence of a specific overt act in the FIR justifies granting bail.
- What conditions, if any, should be imposed on the grant of anticipatory bail.
Legislation cited

3. The learned counsel for the Applicant submits
that the Applicant is innocent and has been falsely implicated in
the present case. It is submitted that even if the allegations

attributed to the Applicant that connects the applicant to the
alleged offence, entails the applicant to protect his liberty.
