Bombay High Court
ADITYA RAJENDRA TAYADEversusTHE STATE OF MAHARASHTRA
- Decided
- Disposal
- Allowed
Holding
The High Court granted anticipatory bail, holding that the applicant’s cooperation and the lack of necessity for custodial interrogation outweighed the prima facie case presented.
Summary
The applicant, Aditya Rajendra Tayade, filed an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with a criminal case (C.R. No. 197 of 2026) alleging an offence punishable under Section 108 of the Bhartiya Nyaya Sanhita, 2023. The Sessions Judge had rejected bail, stating that a prima facie case existed, the applicant was implicated in the harassment of the deceased, and custodial interrogation was necessary. The applicant’s counsel submitted that he would fully cooperate with the investigation and that the main allegations centred on a co‑accused who was already in custody. The High Court, after considering the submissions, held that the circumstances did not warrant denial of bail and that the applicant’s willingness to cooperate satisfied the requirements for anticipatory bail. Accordingly, the Court granted anticipatory bail with a set of conditions, including furnishing a bond, regular police appearances, and non‑interference with witnesses or evidence.
Issues considered
- What is the appropriate exercise of power under Section 482 BNSS in granting or refusing anticipatory bail in a case where a prima facie case appears to exist?
- Whether the applicant’s willingness to cooperate with the investigation negates the need for custodial interrogation and justifies the grant of anticipatory bail.

appears that, C.R. No.197/2026 is registered against
applicant and other co-accused at Lohgaon Police
Station, Pune for the offence punishable under Section
108 of BNS. From the recitals in the FIR and the reply

prima facie appreciation of the material on record,
there appear involvement of applicant in the present
crime. Considering the averments in the FIR and
disclosure in the investigation about harassment of
deceased by the applicant in the close proximity of the
incident and nature of crime, material information in
respect of the crime is likely to be obtained and mobile

the contention of applicant that, custodial
interrogation is not necessary. Moreover, offence
