Holding

The anticipatory bail application was withdrawn by the applicant and therefore no substantive bail order was made.

Summary

The applicant, Chhaya Arvind Misal, filed an anticipatory bail application under section 482 of the Bhartiya Nyaya Sanhita, 2023, seeking release on bail for alleged offences under sections 326(g), 118(1), 115(2), 351(2), 352, 189(2), 190 and 324(5). The matter was heard before Justice Ashwin D. Bobe, during which the applicant's counsel requested a brief adjournment to take further instructions. Subsequently, the counsel sought leave to withdraw the anticipatory bail application, a request that was not opposed by the respondents' counsel. The court, after noting the applicant's intention to withdraw, granted leave to do so. Consequently, the anticipatory bail application was disposed of as withdrawn, with no substantive order on bail being made.
