Bombay High Court

VIKAS DADARAO DONGAREversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
DISMISSED

Holding

A fresh anticipatory bail application filed during a vacation period, absent any change in circumstances, must be dismissed.

Summary

The applicant, Vikas Dadarao Dongare, filed an anticipatory bail application (No. 1746 of 2024) which was later withdrawn after the Court expressed reluctance to entertain it. He subsequently filed a fresh anticipatory bail application (No. 861 of 2026) during the Court's vacation period. The applicant did not demonstrate any material change in circumstances since the earlier withdrawal. The learned Judge observed that without a change in facts, the Court is not obliged to entertain a fresh application during vacation. Consequently, the application was dismissed.
