Bombay High Court
ASHOK S/O MULCHAND AGRAWALversusGANGADHAR S/O VISHWANATH PATIL
- Disposal
- Transfer to other court
Holding
The High Court ordered the transfer of the leave applications to the District and Sessions Court and directed that they be treated as appeals under Section 372 of the CrPC, thereby disposing of the applications.
Summary
The applicant, Ashok Agrawal, filed multiple applications for leave to appeal against an order of acquittal under Section 138 of the Negotiable Instruments Act. He sought transfer of these leave applications to the District and Sessions Court, relying on the Supreme Court’s decision in Celestium Financial v. Ganasekaran (2025). The High Court considered whether such transfer was permissible and how the appeals should be treated under the Code of Criminal Procedure. It ordered that the applications be transferred to the concerned District and Sessions Court and that they be dealt with as appeals under the proviso to Section 372 CrPC, following the Supreme Court’s observations. The Court also directed that the period spent before the High Court be excluded when calculating limitation and disposed of the leave applications.
Issues considered
- Whether leave applications for appeal against acquittal under Section 138 NI Act can be transferred to the District and Sessions Court.
- Whether the Supreme Court’s decision in Celestium Financial v. Ganasekaran governs the treatment of such applications.
- Whether the transferred matters should be treated as appeals under the proviso to Section 372 of the CrPC.
- Whether the period spent before the High Court should be excluded for limitation purposes.
