A victim may file an appeal against an acquittal under Section 372 of the CrPC, as affirmed by the Supreme Court in Celestium Financial v. Ganasekaran.
Summary
The applicant filed a petition seeking leave to appeal an order of acquittal under Section 138 of the Negotiable Instruments Act, 1881. The High Court examined the Supreme Court’s decision in Celestium Financial v. Ganasekaran (2025) which held that a victim may appeal an acquittal under Section 372 of the Code of Criminal Procedure. Relying on that precedent, the Court ordered the matter to be transferred to the appropriate District and Sessions Court for the appeal to be heard as a Section 372 appeal. The Court also directed that the time spent on this leave application not be counted towards the limitation period. Consequently, the leave application was disposed of, and the appeal process was to continue in the lower court.
