The application is transferred to the concerned District and Sessions Court and shall be treated as an appeal under the proviso to Section 372 CrPC, with the period spent before this Court excluded for limitation.
Summary
The applicant, Shivaji Dhondiba Patil, filed an application for leave to appeal against an order of acquittal under Section 138 of the Negotiable Instruments Act, 1881. He sought transfer of the appeal to the District and Sessions Court, relying on the Supreme Court’s decision in M/s. Celestium Financial v. Ganasekaran (2025) SCC OnLine SC 1320. The High Court, after hearing counsel, ordered that the matter be transferred to the appropriate District and Sessions Court, to be treated as an appeal under the proviso to Section 372 of the Code of Criminal Procedure, and directed that the time spent before the High Court be excluded for limitation purposes. The court directed the registrar to effect the transfer and the concerned court to issue notices and proceed accordingly. The application was thereafter disposed.
