Disposal
Transfer to other court

Holding

The appeal is to be transferred to the concerned District and Sessions Court and disposed of as an appeal under the proviso to Section 372 CrPC.

Summary

The appellant Shaikh Imamoddin Nizamoddin appealed against a trial court acquittal under Section 138 of the Negotiable Instruments Act. Relying on the Supreme Court’s decision in Celestium Financial v. Ganasekaran, the appellant sought transfer of the appeal to the District and Sessions Court. The High Court, after noting the precedent and the proviso to Section 372 of the Code of Criminal Procedure, ordered the matter to be transferred to the appropriate Sessions Court. The Registrar was directed to effect the transfer and the Sessions Court was instructed to treat the case as an appeal under Section 372. Consequently, the High Court disposed of the appeal, pending further proceedings in the Sessions Court.
