The appeal is transferred to the concerned District and Sessions Court and shall be dealt with as an appeal under the proviso to Section 372 CrPC, with the time spent before this Court excluded for limitation calculation.
Summary
The appellant, Narsubai Anjaya Yangal, appealed an acquittal under Section 138 of the Negotiable Instruments Act. Relying on the Supreme Court’s decision in Celestium Financial v. Ganasekaran (2025), the appellant sought transfer of the appeal to the District and Sessions Court. The High Court, after considering the precedent, ordered the transfer and directed the Sessions Court to treat the matter as an appeal under the proviso to Section 372 of the Code of Criminal Procedure. It also instructed that the period spent before the High Court be excluded when calculating the limitation period. The order directs the Registrar to effect the transfer and the Sessions Court to issue notices and proceed accordingly.
