CHHAYA BABAN PAWAR AND ORSversusTHE STATE OF MAHARASHTRA D

Decided

The court may correct a typographical error in its order, provided the correction does not alter the substantive effect of the order.

Summary

The respondents filed a praecipe on 3 February 2026 seeking correction of a typographical error in paragraph 7 of the order dated 17 January 2026, where the name of the advocate was incorrectly printed as Mr. Yuvraj Tajane instead of Ms. Iqraa Zabin Qureshi. The court examined whether it has the power to amend the order to rectify the mistake without altering its substantive content. It held that such correction is permissible under its inherent jurisdiction as it does not affect the rights of the parties. Consequently, the erroneous line was substituted with the correct name of Ms. Iqraa Zabin Qureshi, and the rest of the order was left unchanged. The corrected order was directed to be uploaded.
