The court held that a valid arbitration agreement subsists and therefore appointed Mr. Mutahhar Khan as sole arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
Summary
The applicant filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of an arbitrator to resolve disputes arising from an agreement dated 9 October 2023. The respondent acknowledged the existence of the arbitration clause. The court examined the material and concluded that a valid and subsisting arbitration agreement existed between the parties. Consequently, the court exercised its power under Section 11 to appoint Mr. Mutahhar Khan, an advocate of the court, as the sole arbitrator. The order also directed the parties to cooperate with the arbitrator, to file statutory disclosures, and to bear arbitral costs equally, while keeping all merits open for determination by the tribunal.
Issues considered
- Whether a valid arbitration agreement subsists between the parties.
- Whether the application under Section 11 of the Arbitration and Conciliation Act, 1996 is maintainable.
