The Court held that a valid arbitration agreement exists and, under Section 11, appointed Mr. Rubin Vakil as the sole arbitrator.
Summary
The applicant, Vishwakiran Co-operative Housing Society Ltd., filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator pursuant to an arbitration clause in an agreement dated 2 February 2016. The applicant served a notice invoking the arbitration agreement on 2 April 2026, but the respondent, Super Construction, failed to file any reply or affidavit. The Court examined the record, found that a valid and subsisting arbitration agreement existed and that it had been duly invoked. Consequently, the Court appointed Mr. Rubin Vakil as the sole arbitrator and issued procedural directions, including the requirement to file a statutory Statement of Disclosure under Sections 11(8) and 12(1). All substantive issues were left open for determination by the appointed arbitrator, and the costs of the arbitration were ordered to be borne equally by the parties pending any award.
Issues considered
- Whether a valid and subsisting arbitration agreement exists between the parties.
- Whether the Court has jurisdiction to appoint an arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
- Whether the respondent’s failure to respond to the notice affects the appointment of an arbitrator.
