The court appointed Ms. Pranita Saboo as the sole arbitrator to adjudicate the disputes arising under the agreement.
Summary
The applicant filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator pursuant to an arbitration clause in an agreement dated 24 January 2025. The court examined the record and found that a valid and subsisting arbitration agreement existed and had been duly invoked by the applicant's notice dated 9 February 2026. Consequently, the court ordered that the disputes be referred to arbitration before a sole arbitrator. Ms. Pranita Saboo, an advocate of the court, was appointed as the sole arbitrator, with directions on disclosure statements, communication details, and cost sharing. The court kept all merits issues open for determination by the arbitrator and ordered the parties to cooperate with the arbitrator as per the statutory requirements.
Issues considered
- Whether a valid arbitration agreement exists between the parties.
- Whether the application under Section 11 of the Arbitration and Conciliation Act, 1996 is maintainable.
