The court appointed Ms. Shubhra Swami Paranjape as the sole arbitrator to adjudicate the disputes under the arbitration agreement.
Summary
Kotak Mahindra Bank filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of a sole arbitrator to resolve disputes arising from an agreement dated 7 February 2023. The parties had an arbitration clause (Clause 10.15) agreeing to refer any differences to a sole arbitrator. The court examined the validity of the arbitration agreement and its own jurisdiction to appoint an arbitrator. By consent of the parties, the court appointed Ms. Shubhra Swami Paranjape as the sole arbitrator and directed the parties to cooperate with the arbitrator on procedural matters. The order also directed the arbitrator to file statutory disclosures and set out cost-sharing provisions, while leaving all substantive issues, including limitation, open for determination by the arbitral tribunal.
Issues considered
- Whether the High Court can appoint a sole arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
- Whether the arbitration clause in the parties' 2023 agreement is enforceable and triggers the court's jurisdiction.
- Whether the court has jurisdiction to entertain the application for appointment of an arbitrator.
