The court held that a valid arbitration agreement exists and appointed Mr. Jash Gandhi as the sole arbitrator.
Summary
The applicant filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 24 July 2023. The court examined the record and found that the arbitration clause in Clause 10.15 of the agreement had been duly invoked by a notice dated 12 August 2025. Satisfied that a valid and subsisting arbitration agreement existed, the court appointed Mr. Jash Gandhi as the sole arbitrator to hear the matters. The order also directed the parties to provide contact details, required the arbitrator to file statutory statements of disclosure under Sections 11(8) and 12(1), and stipulated that arbitral costs be borne equally by the parties unless altered by a final award. All substantive issues were left open for determination by the appointed arbitrator.
