The court ordered the appointment of Mr. Jash Gandhi as sole arbitrator, confirming the existence of a valid arbitration agreement and its jurisdiction under Section 11.

Summary

The Bombay High Court entertained an application under Section 11 of the Arbitration and Conciliation Act, 1996 filed by Tata Capital Limited seeking appointment of an arbitrator pursuant to an arbitration clause in an agreement dated 8 August 2012. The court examined the notice dated 27 January 2026 and found that the arbitration agreement had been validly invoked and remained subsisting. Consequently, the court held that it had jurisdiction to appoint a sole arbitrator. It appointed Mr. Jash Gandhi as the sole arbitrator, directed the parties to furnish contact details, and ordered equal sharing of arbitral costs pending any award. The order also required the arbitrator to file a statutory statement of disclosure and set the procedural timetable for the arbitration.

Issues considered

  • Whether a valid and subsisting arbitration agreement exists between the parties.
  • Whether the High Court has jurisdiction to appoint an arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
  • Whether the notice invoking arbitration was proper and sufficient.
