Bombay High Court

RAHUL DEVIDAS KALEversusTHE STATE OF MAHARASHTRA

Disposal
DISPOSED OFF

Holding

The bail application was disposed of, i.e., not granted.

Summary

The applicant Rahul s/o Devidas Kale filed a bail application in the High Court of Bombay, Aurangabad Bench. The court noted that the trial had substantially progressed, with only two witnesses remaining to be examined, as per the report from the District Judge-2 and Additional Sessions Judge, Sangamner. The respondent's counsel argued that the remaining witnesses were few and the matter did not warrant further consideration of bail at this stage. Consequently, the court disposed of the bail application without granting relief. The decision reflects the court's view that the trial's advancement precludes the necessity of bail at this point.

Issues considered

  • Whether bail should be granted to the applicant given the advanced stage of the trial
