Holding

The bail application is disposed of, allowing the applicant to withdraw it and approach the Sessions Court.

Summary

The applicant, Shaikh Rahim Shaikh Lal, filed a bail application before the Bombay High Court, Aurangabad Bench. After a co-accused was released on bail, the applicant sought to withdraw his own bail application and approach the Sessions Court for further relief. The Court considered the request in light of an earlier order dated 02.02.2026 that had already permitted withdrawal of the bail application. The Judge held that the applicant could indeed withdraw the bail application and that the Sessions Court would be free to consider any subsequent applications or events. Accordingly, the bail application was disposed of, granting the applicant liberty to withdraw it and proceed before the Sessions Court.

                 FINAL ORDER :

. Learned counsel for the applicant on instructions seeks
leave to withdraw this bail application with liberty to approach
Sessions Court in view of subsequent development of releasing of
                 co-accused on bail.

                 2. Bail application is disposed of with liberty as sought for.

                 3. It is made clear that on earlier occasion while passing
order on 02.02.2026 application for bail was permitted to be
withdrawn. It would be open for Sessions Court to deal with the
application as well as subsequent events.
