PIYUSH NITIN DONDEversusSTATE OF MAHARASHTRA

Decided

The court held that the principle of parity applies and granted bail to the applicant.

Summary

The applicant, Piyush Nitin Donde, filed a bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail in a case involving alleged participation in a dacoity and charges under Section 310(4) of the Bharatiya Nyaya Sanhita, 2023, the Indian Arms Act, 1959, and the Maharashtra Police Act, 1951. The prosecution alleged that the accused were preparing for dacoity on 1 October 2025, but the applicant was not present at the spot where four other accused were arrested. The applicant argued that another co‑accused (Accused No. 5) had been released on bail in a similar circumstance, invoking the principle of parity. The court examined the earlier bail order (Criminal Bail Application No. 1640 of 2026) and found the facts and role of the applicant to be analogous to those of Accused No. 5. Applying the parity principle, the court granted bail with a cash bond of Rs 25,000 and imposed standard reporting and non‑interference conditions. The bail application was therefore allowed and disposed of.

Issues considered

  • Whether the applicant is entitled to bail on the ground of parity with a co‑accused previously released on bail under similar facts.
  • Whether the seriousness of the offences under the Bharatiya Nyaya Sanhita, Indian Arms Act and Maharashtra Police Act precludes the grant of bail.
