Bombay High Court

BHAU NANA CHAVANversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The court held that the interim application for extending the time to comply with bail conditions is not maintainable and therefore dismissed it, while reserving the State’s right to seek cancellation of the bail.

Summary

The applicant, Bhau Nana Chavan, was arrested in a case involving offences under Sections 420, 467, 468, 471 read with 34 of the IPC and sought bail under Section 439 of the CrPC. The trial court granted bail on 3 February 2024, conditioning the applicant to deposit Rs.5 lakh within two months. The applicant failed to comply with the deposit condition and filed an interim application seeking an extension of time, which the court dismissed as non‑maintainable. The State then moved for cancellation of the bail, but the court merely noted the right to apply for cancellation and closed the bail proceedings. Consequently, the interim application was dismissed and the bail application was disposed, leaving the possibility of a future cancellation application by the State.

Issues considered

  • Whether the interim application seeking an extension of time for compliance with bail conditions is maintainable.
  • Whether the failure to comply with bail conditions warrants cancellation of the bail granted.

submitted that there are no other criminal antecedents.

             6. On the other hand, the learned APP for the

Lakhs towards consideration. It is submitted considering the
nature of offence, the applicant may not be released on bail.

             7. The learned counsel for the applicant submits that though
the applicant has not received the alleged amount, still without
