AKSHAY MESHOK INGALEversusTHE STATE OF MAHARASHTRA

Disposal
APPLICATION ALLOWED

Holding

The Court allowed the interim bail application, granting bail for 88 days subject to a personal bond, surety and specific monetary and procedural conditions.

Summary

Akshay Meshok Ingale was arrested on 13 June 2024 in connection with Crime No. 521 of 2024 for offences under IPC sections 420, 406, 409 read with 34 and Section 3 of the Maharashtra Protection of Interest of Depositors Act. He filed a third bail application, offering to deposit Rs 5 lakhs immediately and Rs 50 lakhs within two months. The State opposed, noting two earlier rejections and no change in circumstances. The Court observed that the investigation was complete and custody was no longer necessary, and therefore granted interim bail for 88 days subject to a personal bond, surety, and a series of conditions including the stipulated deposits. The main bail application remains pending, while the interim bail and related criminal applications are disposed of on the terms specified.

Issues considered

  • Whether interim bail should be granted despite prior rejections of the applicant's bail applications
  • Whether the completion of investigation removes the necessity of custodial interrogation
  • Whether the applicant's offer of monetary deposits and surety satisfies the conditions for bail
