Bombay High Court

SACHIN NARSU CHAUGHULEversusTHE STATE OF MAHARASHTRA

Disposal
APPLICATION ALLOWED

Holding

Bail was granted to the accused on the condition of a fresh bond, surety, and compliance with specific undertakings.

Summary

The accused, Sachin Narsu Chaughule, was previously released on bail for offences under Sections 354-A, 354-B, 323, 506 of the IPC and Sections 8, 12 of the POCSO Act, but failed to appear, leading to a non‑bailable warrant. He applied for bail again, claiming the need to earn a livelihood and offering to give an undertaking to attend all trial dates. The State opposed, highlighting his prior default and the seriousness of the crimes, especially the victim being an eight‑year‑old child. The Court noted the applicant's readiness to furnish an undertaking and, considering the circumstances, granted him a fresh bail with a fresh bond, surety, and specific conditions. The bail order also warned that any further default would result in cancellation of bail.
