Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court condoned the 71‑day delay and granted a stay of execution pending the appeals.

Summary

The plaintiff, Chola MS General Insurance Company Ltd, filed multiple applications seeking condonation of a 71‑day delay in filing its first appeals and a stay of execution of the impugned judgment and award. The court examined the reasons for the delay and, finding them satisfactory, condoned the delay in the interest of justice, allowing the appeals to be registered. The plaintiff also asserted that the entire amount awarded had been deposited with the court, and consequently the court granted a stay of the judgment and award pending the resolution of the appeals. The applications for both condonation and stay were therefore disposed of in the plaintiff’s favour. The court directed that notice be issued to the respondents and set a return date of 30 June 2026 for the appeals.
