Delay is condoned but applicants are barred from claiming interest or statutory benefits for the delayed period, and for two applications also for the period of lapses.
Summary
The applicants, a group of landowners, filed numerous civil applications seeking condonation of delays ranging from 3,167 to 4,754 days in preferring first appeals against the State of Maharashtra's acquisition orders. They argued that the delays were justified and that the appeals could be finally decided as per earlier judicial view. The State contested the applications, but the court found the averments uncontroverted and saw no mala‑fides on the part of the applicants. The court conditioned the condonation on the applicants relinquishing any claim to interest or statutory benefits for the period of delay. For two specific applications (Civil Application Nos. 3477 and 3478 of 2026) the court further barred any benefit for the period of lapses from filing to the first order. The court ordered the registration of the first appeals and disposed of the civil applications.
Issues considered
- Whether delay of 3,167 to 4,754 days in filing first appeals can be condoned.
- Whether applicants are entitled to interest and statutory benefits for the period of delay.
- Whether applicants can claim benefits for the period of lapses between filing and first order in the two specific applications.
