The panel held that the settlement is valid and ordered its implementation as per the terms of Exhibit‑X.
Summary
Magma HDI General Insurance Co. Ltd. appealed a stamp matter before the National Lok Adalat of the Bombay High Court, Aurangabad Bench, seeking resolution of a claim by Rekha Chandrakant Samale and other family members. The panel, after verifying the identities of the claimants and confirming that three of them were minors, examined the compromise terms submitted as Exhibit‑X, which included Aadhar extracts and an authority letter from the insurer. The Lok Adalat determined that the proposed settlement was in the best interest of the minors and permissible under the Legal Services Authorities Act. Accordingly, it ordered the insurer to pay Rs.24,00,000 to the claimants as full and final settlement, with any balance and accrued interest to revert to the insurer. The appeal was disposed of on the basis of this settlement, and any pending civil applications were also closed, with a directive to refund court fees as per law.
Issues considered
- Whether the settlement is in the best interest of the minor claimants
- Whether the Lok Adalat can dispose of the first appeal under the Legal Services Authorities Act
- How the settlement amount should be allocated between the claimants and the insurer
