Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court held that sufficient cause existed to condone the 299‑day delay and granted an ad‑interim stay subject to the deposit of 60% of the compensation with interest.

Summary

The Executive Engineer Minor Irrigation Division Latur and others filed applications seeking condonation of a 299‑day delay in filing their appeal, citing administrative reasons. The respondents, Meena Prabhu Kore, opposed the condonation and also contested an interim stay of the judgment and award. The Court examined the reasons for delay and found them sufficient, thereby allowing the condonation and directing registration of the first appeals subject to removal of any office objections. It also entertained the stay application, waiving notice, and ordered an ad‑interim stay of the judgment and award pending a returnable date, conditioned upon the applicants depositing 60% of the compensation amount with accrued interest. The orders were pronounced by Justice S. G. Chapalgaonkar on 6 August 2026.

Issues considered

  • Whether a delay of 299 days in filing an appeal can be condoned under the applicable procedural law.
