The Court condoned the 90‑day delay, restored the first appeals and allowed the civil applications subject to removal of office objections.
Summary
The applicants, Kashinath Sonji Patil, Bhagwat Janrao Patil and Ramesh Laxman Padol, filed applications seeking condonation of a 90‑day delay in filing applications for restoration of their first appeals and accompanying civil applications against the State of Maharashtra. The primary issue was whether the Court could condone the delay and restore the first appeals, subject to the applicants removing any office objections. The Court examined the reasons provided in the applications and found them sufficient to justify condonation. Consequently, the Court ordered that the delay be condoned, the first appeals be restored, and the civil applications be allowed as per prayer clauses B and C, subject to the applicants’ undertaking to clear any office objections. The civil applications were thereafter disposed.
Issues considered
- Whether a delay of 90 days in filing applications for restoration of first appeals can be condoned
- Whether the first appeals should be restored upon condonation
- Whether the civil applications should be allowed subject to removal of office objections
