Holding
The Court condoned the delay subject to the condition that the applicants shall not claim interest or statutory benefits, and held that forfeiture does not apply to applications No. 3405/2025 and 4011/2025.
Summary
The High Court of Bombay, Aurangabad bench, considered six civil applications seeking condonation of delay in filing first appeals against orders of the Collector, Jalna. The applicants admitted substantial delays ranging from 859 to 2,183 days and offered to forgo interest and statutory benefits for the delayed periods. The respondents did not contest the averments but highlighted the applicants' lapses. The Court examined whether the delay could be condoned and whether the applicants could claim interest or statutory benefits, and also considered the applicability of forfeiture of benefits. It held that the delays are condoned on the condition that no interest or statutory benefits are payable, and expressly ruled that forfeiture does not apply to applications No. 3405/2025 and 4011/2025. Consequently, the civil applications were allowed and disposed of, and the first appeals were ordered to be registered.
