YANKAJI RANGNATH GHADGE (DIED) THR. LRS KESHARBAI YANKAJI GHADGE AND ANRversusTHE STATE OF MAHARASHTRA THROUGH COLLECTOR JALNA AND ORS

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The delay is condoned on the condition that the petitioners shall not be entitled to interest or statutory benefits for the delayed period and the lapse from 11‑Nov‑2024 to 03‑Sep‑2025.

Summary

The petitioners, heirs of the deceased Yankaji Rangnath Ghadge, filed a civil application against the State of Maharashtra and the Collector, Jalna, seeking relief under a land‑acquisition matter. The court noted that the petitioners' averments were not contested and that the delay in filing was unintentional. The petitioners agreed to forgo any interest and statutory benefits accrued during the period of delay. The court conditioned the condonation of delay on the forfeiture of such interest and benefits for the period from 11‑Nov‑2024 to 03‑Sep‑2025. Consequently, the civil application was allowed, and a notice for final disposal was issued, with the State’s advocate waiving service of the notice.
