Interest under Sections 28 and 34 of the Land Acquisition Act shall be payable in accordance with the law laid down by the Full Bench in State of Maharashtra v. Kailash Shiva Rangari (2016).
Summary
The Executive Engineer, Osmanabad Medium Project appealed against the State of Maharashtra and others concerning the payment of interest on compensation awarded under the Land Acquisition Act, 1894. The appeal was heard before a National Lok Adalat panel, with the appellant represented by counsel Mr. Gulab Rajale and Smt. S.D. Shelke, and the State represented by A.G.P. Mr. A.M. Phule. The sole issue was the quantum of interest payable under Sections 28 and 34 of the Act, which the court affirmed must follow the precedent set in State of Maharashtra v. Kailash Shiva Rangari (2016). The panel disposed of all first appeals, modifying them only to the extent that interest be calculated as per that precedent, and confirmed the rest of the award. Consequently, the claimants were directed to return any overpaid amounts, and the record was sent back to the reference court for appropriate recovery proceedings.
Issues considered
- Whether interest on compensation under Sections 28 and 34 of the Land Acquisition Act, 1894 is payable as per the decision in State of Maharashtra v. Kailash Shiva Rangari
