Bombay High Court

THE STATE OF MAH AND ANRversusVINAYAK SHANKARRAO MANE

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court condoned the delay in filing the first appeals and allowed the applications, while disposing of the stay applications as infructuous.

Summary

The State of Maharashtra filed several civil applications seeking condonation of delay—209 and 208 days respectively—for filing first appeals, citing the time taken to obtain directions from the Law and Judiciary Department. The learned Advocate General for the State argued that the delay was not deliberate and requested the court to condone it. The Court, after reviewing the applications, held that the delay was not intentional and, in the interest of justice, allowed the applications and condoned the delay. Separate applications seeking a stay of execution of the impugned judgment were also filed, but the Advocate General could not confirm whether the compensation amount had been deposited, and the claimants were presumed to have received it. Consequently, the Court disposed of those stay applications as infructuous. Notices were issued for the final hearing of the first appeals, scheduled for 27 February 2026.

Issues considered

  • Whether the delay of 208-209 days in filing the first appeals can be condoned under procedural law
  • Whether a stay of execution should be granted when the compensation amount is presumed to have been paid

                                      CORAM : SANJAY A. DESHMUKH, J.
                                      DATED : 02ND FEBRUARY, 2026
                PER COURT :-

CIVIL APPLICATION NO. 16390 OF 2010
CIVIL APPLICATION NO. 16392 OF 2010

                1. These are the applications filed for condonation of delay of

209 and 208 days respectively caused for filing the respective First

                Appeals.

                2. Learned AGP for the applicant-State submitted that the time

was consumed in obtaining the necessary directions from the Law and

Judiciary Department, and therefore, the delay is occurred. He lastly

prayed to allow the applications and condone the delay.

                3. Upon perusal of the application this Court is of the view that

the respective delay is not deliberately caused and applications

deserve to be allowed in the interest of justice. Hence, the following

                order:
                                                        41-ca-16390-2010+
                                  -2-

                                ORDER

a. Both the Civil Applications are allowed.

b. Delay 209 and 208 days respectively caused for filing the

respective First Appeals is condoned.

c. Both the Civil Applications are disposed of.

CIVIL APPLICATION NO. 16391 OF 2010
CIVIL APPLICATION NO. 16393 OF 2010

1. Both these applications are filed for granting stay to the

execution and operation of the impugned judgment and award.

2. Perused the applications. Heard learned AGP for the

appellant-State. The claimant is absent.

3. Learned AGP for the appellant-State is unable to state

whether the amount has been deposited in this Court or in the learned

Reference Court. However, considering the fact that the applications

were filed in the year 2010, the respective claimants must have

received the amount of compensation. There is no point in keeping

these applications pending; hence, the following order:

                                ORDER

a. Civil Applications are disposed of as infructuous.
                                                         41-ca-16390-2010+
