The Court condoned the delay and allowed the applications for condonation, while disposing the stay applications as infructuous.
Summary
The State of Maharashtra filed four civil applications seeking relief in connection with two first appeals (ST No.31208/2010 and ST No.31214/2010). Applications 16390/2010 and 16392/2010 pleaded for condonation of a delay of 209 and 208 days respectively in filing the first appeals, attributing the delay to the time taken to obtain directions from the Law and Judiciary Department. The Court, after noting that the delay was not deliberate, allowed both applications and expressly condoned the delay in the interest of justice. Applications 16391/2010 and 16393/2010 sought a stay of execution of the impugned judgment and award, but the claimant was absent and the State could not confirm deposit of the compensation amount. Since the applications were filed in 2010 and the compensation would have been paid, the Court deemed the applications infructuous and disposed of them. The orders also directed notice to respondents for a final hearing of the first appeals scheduled for 27‑02‑2026.
Issues considered
- Whether the delay of 208‑209 days in filing the first appeals can be condoned under the principles of justice.
- Whether the applications seeking a stay of execution and operation of the judgment are maintainable given the claimant's absence and uncertainty about deposit of compensation.
