The application for condonation of delay and amendment is allowed.

Summary

The applicant filed a petition seeking condonation of a 1521‑day delay in filing an application to set aside an abatement, to bring the legal representatives of respondent No.4 on record, and to effect an amendment. The High Court examined the application and heard counsel for both parties. Considering the antiquity of the matter and the grounds pleaded, the Court found the reasons for delay sufficient to merit condonation. Consequently, the Court allowed the application, directing that the amendment be completed within two weeks, failing which the applicant must pay Rs.2,000 to the High Court Legal Services Sub‑Committee. The Court also ordered the listing of related appeals and contempt petitions for hearing on 14 July 2026 and directed the appellant to furnish an amended appeal memo to the respondents before the next date.
