The court held that the delay may be condoned and the appeals restored to their original position.
Summary
The petitioners, Devidas (deceased) represented by LRs Chaturabai & others and Sopan (deceased) represented by LRs Ramkala & others, filed two civil applications before the Bombay High Court, Aurangabad Bench, seeking condonation of delay in applying for restoration of their appeals, which had been dismissed for failure to remove office objections. The court examined whether the delay could be condoned and the appeals restored despite the earlier dismissal. It held that the delay was condonable and ordered the restoration of the appeals to their original position. The petitioners were directed to remove the office objections within two weeks, after which the office would issue notice to the respondents with a return date of 06‑04‑2026. The matter was to be finally decided at the admission stage as it involved covered matters.
