Bombay High Court

THE STATE OF MAHARASHTRA THROUGH THE DIST. COLLECTOR, LATUR AND OTHERSversusJAYASH KISHNAJI GANGAR

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court condoned the 420‑day delay and allowed the civil applications, while staying further proceedings until compliance with the deposit order.

Summary

The State of Maharashtra, through the District Collector of Latur, filed multiple civil applications seeking condonation of a 420‑day delay in filing appeals, citing administrative reasons. The applications also requested a short accommodation to instruct why a court‑ordered amount had not been deposited, and warned that an affidavit would be filed if the amount remained unpaid. The bench examined the justification for the delay and found it satisfactorily explained. Consequently, the court condoned the delay, allowed the civil applications, and ordered that the appeal be registered after removal of any office objections. Additionally, the court stayed further proceedings pending compliance with the deposit order, directing the matter to stand over to 30 July 2026.

Issues considered

  • Whether a delay of 420 days in filing appeals can be condoned on administrative grounds.
  • Whether a stay should be granted pending deposit of the amount ordered by the court.

  • delay condonation
  • civil applications
