The delay in filing cross‑objections is condoned in the interest of justice.

Summary

The petitioners, Dattu Yadavrao Mane (deceased) and Geetabai Eknath Chaugale, filed applications seeking condonation of a 4,765‑day delay in filing cross‑objections in civil proceedings against the State of Maharashtra. The State and the acquiring body opposed the condonation, arguing there was no sufficient reason for the delay. The Court examined the applications and found that the delay was not deliberately caused. In the interest of justice, the Court decided to condone the delay subject to conditions. Consequently, the applications were allowed, but the Court clarified that any enhancement of compensation would not attract interest or other statutory benefits for the delayed period.
